Terms & Conditions

1. Definitions

In these Terms and Conditions: "Pine Court" or "we" refers to the residential home operating at 73 Cheung Sha Wan Road, Sham Shui Po, Kowloon, Hong Kong. "User" means any person who accesses this website or uses our services. "Service" refers to the residential arrangements offered by Pine Court, including Meadow Residence, Garden Therapy Sessions, and Weekend Garden Stay. "Agreement" refers to these Terms and Conditions together with any specific service arrangement entered into between Pine Court and a resident or their representative.

2. Acceptance of Terms

By using this website or enquiring about our services, you confirm that you are 18 years of age or older and have the capacity to enter into this agreement. Use of the website constitutes acceptance of these terms as currently published. For service arrangements, a separate residential agreement will be provided and must be signed by the resident and/or their authorised representative.

3. Services

Pine Court provides non-medical residential accommodation and related programmes for elderly adults in Hong Kong. Our services are not a substitute for medical, nursing, or clinical care. We are registered under the Residential Care Homes (Elderly Persons) Ordinance (Cap. 459). Service availability is subject to capacity and suitability assessment. Pine Court reserves the right to decline an arrangement if the home cannot appropriately meet a prospective resident's needs.

5. Payment Terms

Fees for each arrangement are as described on our website and in any written service agreement. Meadow Residence fees are payable monthly in advance. Garden Therapy Session fees are payable monthly. Weekend Garden Stay fees are payable in advance of the stay. Fees are stated in Hong Kong Dollars (HKD). Pine Court reserves the right to review fees with reasonable notice. Where fees are unpaid, Pine Court may, after reasonable attempts at resolution, consider this a breach of arrangement.

6. Cancellation and Refund Policy

For Meadow Residence, a notice period of one calendar month is required to end an arrangement. For Garden Therapy Sessions, one month's notice is also required. For Weekend Garden Stay, cancellations made more than 48 hours in advance will be fully refunded. Cancellations within 48 hours of the stay may not be refunded, at the discretion of Pine Court. In the event of a medical emergency, arrangements will be considered on a case-by-case basis.

7. Intellectual Property

All content on this website — including text, imagery, and design — is the property of Pine Court unless stated otherwise. You may view and print content for personal, non-commercial purposes. Reproduction or redistribution for other purposes requires our written permission.

8. Disclaimers

Pine Court provides residential care and companionship services to the best of its ability. We do not provide medical, nursing, psychological, or diagnostic services. Information on this website is for general guidance only. We do not make any undertakings as to specific outcomes of our residential or therapy programmes. The website is provided as-is and we make no representations as to its accuracy or completeness at all times.

9. Limitation of Liability

To the extent permitted by Hong Kong law, Pine Court's liability to any person arising from the use of this website or our services shall be limited to the amount paid by that person for the relevant service in the month during which the relevant event occurred. We shall not be liable for indirect, incidental, or consequential damages.

10. Termination

Either party may end a service arrangement with appropriate notice as described in Section 6. Pine Court may end an arrangement with immediate effect where: a resident's needs can no longer be safely or appropriately met by the home; a resident or family member has acted in a manner harmful to others or to the operation of the home; or fees remain unpaid after reasonable attempts at resolution. Termination by Pine Court for reasons within our control will be handled with care and reasonable advance notice wherever possible.

11. Governing Law and Disputes

These Terms are governed by the laws of the Hong Kong Special Administrative Region. Any disputes shall first be addressed through direct communication. If a resolution cannot be reached informally, the parties may seek mediation. Courts of the HKSAR shall have jurisdiction over any matter that proceeds to formal dispute.

12. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised date. Continued use of our website or services after changes have been posted constitutes acceptance.
